Neil Barnard judgment

The ANC has taken note of the Cape High Court judgment which today ruled that a voluntary organisation such as the ANC can be sued.

We believe that the only reason this issue is being kept alive is because Neil Barnard has been given a blank cheque by the provincial government who is paying for all his legal fees at taxpayers` expense.

This is despite the fact that the ANC had withdrawn the allegation against Dr Barnard and apologised.

On the face of it the judgement raises serious questions of freedom of speech and also potentially limits the ability of community and political organisations to make critical comments about the public service and matters of public importance.

After studying the judgement carefully we will consider our options.
